General Terms and Conditions of Sales and Delivery

§1 General Information and Contractual Partners

By using the mymuesli website, you agree to these conditions and signify to be bound by them. Therefore please read these conditions very carefully before using the mymuesli website. Your contractual partner for all orders within the scope of this website and online offer is mymuesli (mymuesli GmbH, Rößlerhofweg 6, 94036 Passau, Germany, listed in the Commercial Register at the Court of Passau - Amtsgericht - under number HRB 4113), hereafter referred to as mymuesli. All deliveries from mymuesli to the customer within the UK are carried ut based on the general terms and conditions given below and underlie all offers and agreements between mymuesli and the customer.

Please note: These terms and conditions only apply to customers living in the United Kingdom.


§2 Conclusion of the contract, payment

1. All offers from mymuesli on our websites are non-binding offers or invitations for the customer to place an order.
2. After finishing his order by sending off the order form on our website (his offer) the customer receives a confirmation via email. This email also comprises the conclusion of the contract subject to the provisions under §3.
3. Payment is carried out either via Paypal or services provided by Moneybookers Ltd. mymuesli is therefore entitled to make use of the services of those parties. If the customer chooses to carry out his payment via Paypal or services provided by Moneybookers Ltd. the contractual relations between the customer and the third parties mentioned are only subject to the Terms and Services of either Paypal or Moneybookers Ltd.


§3 Shipment

Delivery is made to the buyer‘s shipping adress. Delivery is carried approximately seven days after after the buyer carried out his payment as described under §2. The customer has to pay standard shipping costs - at this time £5,90.


§4 Right of withdrawal

If one of the following applies, mymuesli reserves the right of withdrawal from the contract:
1. Shortage of raw material
2. Punctual and correct supply of all goods and raw materials to mymuesli. This shall not apply if mymuesli can be held responsible for non-delivery. Of course - in the case of advance payment - all money will be reimbursed if already paid for by the customer. mymuesli will inform the customer as promptly as possible about these special circumstances.


§5 Limitation of Liability

Liability on the part of mymuesli follows statutory provisions – insofar as nothing else is determined in these general terms and conditions. mymuesli only bears unlimited responsibility for damages in the case of deliberate action and gross negligence.


§6 Conditional Sale

Up to the payment of any money owed to mymuesli the goods remain the property of mymuesli. If the customer is a merchant according to the German Commercial Code (HGB), mymuesli remains owner of all delivery items up to the receipt of all payment due resulting from the business relationship.


§7 Contract Cancellation

As each ordered muesli is a customised product, we regret that we cannot take cancellations for muesli orders (§312d IV Nr. 1 German Civil Code).
